That is true. However, only law enforcement can debunk that claim. So far no one has. There are many instances where stops are made for no reason at all and logic will arrive at any one of the following conclusions. The cop was bored and decided to go power tripping or the cop needed to accumulate the points as dictated by their department. Why else in your opinion would she have stopped him?

That is a good move in my opinion. To try to earn their wages by making false stops and charges makes no sense when the taxpayers pay their wages. Not to mention the amount of money it would cost to go through the courts and possibly collection costs. The state would lose money.

Having talked to ranking cops in traffic departments officers in a couple of large Southern California Cities, their officers are reviewed based on the number of tickets they write. That may not be an official quota, but they all know if they don’t write enough tickets and generate enough revenue, it will have an effect on the job performance review.

This is the same officer that turned around and tried to give them a loitering ticket yet he kept saying repeatedly can I have my ID to go and she kept detaining him how is he loitering if she won’t let him leave. And even at that point you cannot be arrested for smoking when you can legally buy cigarettes if you were above the age to buy cigarettes you cannot be arrested for smoking a cigarette that you legally purchased from the store
So they’re charging him for loitering when he has asked multiple times to leave and they said he couldn’t.

When people try to confront authorities simply because they face it has no explanation. A police authority can ask the questions they want to ensure compliance by the population and your duty as a civil is to respond honestly, it’s simple.
How did not answering a question obligate an officer to unlawfully detain him, obstruct justice by lying about seeing him smoke, deny him with leaving, and then finally create a false police report AND false criminal charge of loitering?
I mean, yeah she didn’t have the right to detain him. You have to think though, she is a female cop. She walks up to a guy on private property and just simply ask him a question. I would’ve just said “no ma’am I’m not a smoker,” showed the whites of my pockets, and that would’ve been that. When you don’t comply, you’re usually held for suspicion because most people don’t just stand around on private property without have been doing something fishy. I don’t get the mentality of everyone thinking cops are out to get them.. when they aren’t. To be fair, she might have received a complaint from someone that he was standing there and that’s why she was holding him. It’s as simple as merely having a conversation..
